Terms of Use

Please read these Terms of Use ("Terms") carefully before downloading or using the SnapShade mobile application ("App"). These Terms constitute a legally binding agreement between you ("User", "you") and SnapShade ("we", "our", "us").

By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not download or use the App.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use SnapShade. By using the App, you represent that you meet this age requirement. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

SnapShade is an AI-powered mobile application that allows users to:

• Upload selfie photos to receive AI-generated hairstyle and hair color transformations.
• Browse and try different hair styles from a curated style library.
• Save and share transformation results.
• Purchase additional transformation credits or subscribe to a premium plan.

AI-generated results are approximations for preview and entertainment purposes only. SnapShade does not guarantee that any hairstyle will look exactly as shown when applied in real life.

3. User Accounts

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account credentials secure and confidential.
• Notify us immediately of any unauthorized use of your account at mehmetirmaakk@icloud.com.
• Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & In-App Purchases

SnapShade offers free and premium service tiers. The following terms apply to all purchases:

• All purchases are processed by Apple through the App Store. We do not directly handle payment information.
• Subscription prices and plans are displayed within the App before purchase.
• Free trials (if offered) automatically convert to paid subscriptions at the end of the trial period unless cancelled at least 24 hours before the end of the trial.
• Subscriptions automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage and cancel your subscription at any time via your Apple ID account settings.
• Credits purchased are non-refundable and non-transferable except as required by applicable law.
• Refund requests must be submitted directly to Apple. We follow Apple's refund policies.

5. User Content & License

You retain full ownership of any photos and content you upload to SnapShade. By uploading content, you grant SnapShade a limited, non-exclusive, royalty-free, worldwide license to:

• Process and transmit your photos to our AI service solely to generate transformation results.
• Cache transformation results temporarily to improve performance.

This license terminates as soon as your session ends or your content is deleted. We do not claim ownership of your photos and will not use them for training AI models without your explicit consent.

You represent and warrant that:

• You own or have the right to use all content you upload.
• Your content does not violate any third party's rights (including privacy, intellectual property, or publicity rights).
• You have obtained consent from any identifiable individuals in uploaded photos.

6. Prohibited Conduct

You agree not to:

• Upload photos of any individual without their explicit consent.
• Use the App to generate, share, or distribute non-consensual intimate imagery or deepfakes.
• Use the App for any illegal, defamatory, harassing, or fraudulent purpose.
• Attempt to reverse engineer, decompile, or extract the App's source code or AI models.
• Use automated scripts, bots, or scrapers to access the App or its services.
• Circumvent, disable, or interfere with security-related features of the App.
• Use the App in a manner that violates Apple's App Store Terms of Service or guidelines.
• Resell, sublicense, or redistribute the App or its services without our written permission.
• Impersonate any person or entity or falsely claim an affiliation with any person or organization.

Violation of these prohibitions may result in immediate account suspension and potential legal action.

7. Intellectual Property

The App, including its design, code, AI models, style library, and all related content, is owned by SnapShade and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

AI-generated transformations created using your uploaded photos may be downloaded and used for personal purposes. Commercial use of generated images is not permitted without our prior written consent.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY AI-GENERATED CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNAPSHADE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM:

• Your use of or inability to use the App.
• Any decisions made based on AI-generated content or results.
• Unauthorized access to your account or data.
• Third-party services or content accessed through the App.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO SNAPSHADE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless SnapShade and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimer of warranties, and limitation of liability) shall survive.

You may terminate your use of the App at any time by deleting the App from your device. To delete your account, contact us at mehmetirmaakk@icloud.com.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which SnapShade operates, without regard to conflicts of law principles. Any disputes arising from these Terms or your use of the App that cannot be resolved informally shall be subject to binding arbitration or, where arbitration is not enforceable, the exclusive jurisdiction of courts in the applicable jurisdiction.

Before initiating formal proceedings, you agree to first contact us at mehmetirmaakk@icloud.com to attempt an informal resolution.

13. Apple-Specific Terms

As the App is distributed via the Apple App Store, the following additional terms apply:

• These Terms are an agreement between you and SnapShade, not with Apple. Apple has no responsibility for the App or its content.
• Apple has no obligation to provide maintenance, support, warranty, or product claims related to this App.
• In the event of any third-party intellectual property claim relating to the App, Apple is not responsible for the investigation, defense, or settlement of such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• Your use of the App must comply with Apple's App Store Terms of Service.

14. Changes to Terms

We reserve the right to update these Terms at any time. When we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, by sending an in-app notification. Your continued use of the App after changes constitutes your acceptance of the revised Terms.
